Terms of Service
Version 2026-09-28. The English text is the binding one.
Effective 2026-09-28.
1. What this is
Give a Dam is a service run by Alborz Mirzaie, a sole proprietor in Texas ("we", "us"). You answer a few private questions, add one photo, choose a look, and keep one short line. We print that as a 4 x 6 inch paper postcard and mail it by USPS First-Class within the United States. The card is the product. Nothing digital is delivered, and the preview in the app is not a product.
"The Service" means the app, the web pages we run for recipients (the claim page and the reply-code page), and the printing and mailing behind them. Senders agree to these terms and to our Privacy Policy when they create an account or place an order. A recipient who uses a claim link asks us to use their address for that one card and acknowledges the Privacy Policy; they do not create an account and do not take on a sender's obligations.
We also offer a monthly card subscription, described in section 3.
2. Who may use it
- You must be 18 or older. You confirm this when you create an account. Where you send a card to a friend, you confirm the person receiving it is an adult too.
- One account per person, tied to an email address you control. Keep the sign-in codes we send you to yourself.
- The Service is offered in the United States and mails only to addresses in the United States.
- We may refuse or close an account that breaks these terms, and we may decline any single card. When we decline a paid single card or a card from a pair, we refund it as described in section 8. Subscription cards follow the subscription rules in sections 3, 7, 8 and 13.
3. What you are buying
- One order is one physical card. A "two cards" purchase is one card now plus one credit for a later card (section 7).
- Before you pay we show the date by which we will hand your card to the postal service. We store that date with your order and repeat it in your receipt and in the app. For a card sent by link, we mail within two weeks of the recipient adding their address. We cannot promise an arrival date. Cards carry no return address, so mail the post office cannot deliver is lost.
- We choose to take a set number of single cards each week. It is a limit we set, not a limit of our equipment. When a week is full, your order takes the next week with room, and the date we show before you pay is that week's date. Subscription cards have their own places.
- The address on the card is the one you gave us, or the one a recipient gave us through a claim link. Check it. We print it as entered.
- The card follows the layout you saw in the app: photo, panel, caption, serial number, your line, and on the back your optional note, how you chose to be named, and a reply code. Colors on paper differ a little from a screen.
- We say when your card was mailed in the app. "Mailed" is the point of no return (section 8).
You choose one to four physical cards each month and name the people we make them for, each with a saved US address, yourself included if you like. For seven days after a paid month opens, you may make its cards yourself in the app at no extra charge, to any US address you choose or enter; each card you make takes the place of a card we would have made for the first person on your list whose cards for that month are not yet filled. After those seven days, or when you choose "Leave it to me", we choose and make the remaining cards for the people you listed. We mail each month's cards within fourteen days of the month opening, whoever makes them. It costs $13.00 a month or $142.00 a year per card, in US dollars, tax included. Your saved payment method is charged when you enrol and automatically each month on the same day of the month, or each year on the same month and day, until you cancel. If that day does not exist in a month, renewal falls on its last day; billing dates use UTC. To stop the next charge, open your subscription in Your cards, choose "Cancel at the end of the period", and confirm before the renewal date shown there. On both plans, the app sends an email 30 days before each anniversary of enrolment, stating the product, renewal date in UTC, total charge for your chosen quantity, cancellation deadline and route, business contact, and links to the versioned Terms and Privacy Policy. For the yearly plan, this is before the yearly renewal charge; for the monthly plan, it is the annual reminder of the monthly charge that continues. Stripe sends no renewal reminder. When your first payment succeeds, the app emails your accepted subscription disclosure, quantity, amount, cancellation policy and route, business contact, and those versioned links. Every paid month sends its cards, including the remaining months of a paid year after you cancel. There is no pause and no skip.
4. How the line is made
- On For me, For a friend and Ask one thing, the app drafts a line from your answers and we print it without showing it to you first; you and the recipient read it on the card. Before it is printed, the person who runs this service reads your answers and the draft, and approves the draft, asks for another, or writes the line himself; a line he writes is held to the same rules as the draft. You accept the line as printed by choosing one of those spokes. We provide the drafting, the reading, the layout, the printing, and the mailing.
- A poem for you works the same way: the app writes a short poem from your answers, the person who runs this service reads it and approves it or writes his own, and we print it without showing it to you first. The poem is screened before it is printed and may be held, released, or declined; a declined card is refunded as described in section 8. It prints on the back of the card when it does not fit the front, in place of a note.
- My own words is the one spoke where you write the line yourself and see it before you pay. You choose those words and ask us to print and mail them.
- You are responsible for the words you choose, the photo you use, the person you choose, and the address you give.
- On the answer spokes, the line or poem is drafted by a language model or written by the person who runs this service after reading your answers. On Draw, the words are a quotation from a published work, credited on the card. The words are not advice of any kind, and they can be wrong, flat, or off in ways we did not anticipate.
- Your answers are used to write the line or the poem, screen the card, and keep a record of the settled card so we can learn what people like and make better cards. They are never printed as written or shown to the recipient; the operational copy follows its deletion clock, and the record-store copy stays while your account exists, as described in the Privacy Policy. Before your first card, the app asks your permission to send your answers to Anthropic, your cropped photo to OpenAI, and words the person who runs this service writes for your card to Google's Gemini for translation; nothing goes to any of them until you allow it. Gemini translates only those words, which may include your name or a friend's name; your answers are not sent to it. When Gemini cannot be used, Anthropic translates those words instead. The day you were born, if you gave it, stays on your account and goes to none of them.
- Some cards are held for a human look before printing. We may hold a card if it may break section 5 or involve someone under 18. You will see "We need a moment with this one." We then release the card, or decline it, and a declined card is refunded as described in section 8. We do not have to give a reason. A card on the three spokes above, and a poem, also waits for the reading described there; it is not printed until that is done.
- We may screen, hold, refuse, or remove a card. Screening does not promise that a line is safe, accurate, or suitable.
On a subscription card we choose for you, the words are a quotation from a published work, credited on the card, or a line the operator writes. The app can show the picture before mailing; the words are shown after the card is mailed. A subscription card you make yourself follows the rules of the kind of card you choose.
5. Your content and your promises
You keep every right you have in your photo, your answers, and your words. You give us a license to store, process, render, print, and mail them for your order, and to keep the settled card record described in the Privacy Policy while your account exists to learn what people like and make better cards.
When you place an order you confirm that:
- the photo is yours to use, or you have permission to print and mail it;
- the card is meant kindly: it is not sent to threaten, humiliate, pressure, stalk, or harass anyone, and not to someone who has asked you not to contact them;
- the card does not state a fact about another person that you know is false, and does not reveal another person's private information without permission;
- the recipient is an adult, and the card contains nothing sexual, no nudity, no hate, and no threats;
- you are not impersonating anyone, and the name you put on the card is yours to use;
- you are sending a personal card, not advertising, bulk mail, or a solicitation.
We may decline a card that breaks these promises, before or after payment, and we may close the account behind it. We read your answers for the review and screening in section 4, and the operator can read the retained card record to learn what people like and make better cards, as described in the Privacy Policy.
6. Recipients
Anyone who receives a card from the Service, whether or not they have an account, can:
- decline a card offered through a claim link before accepting it, without giving a reason; the sender gets back what they paid, or their credit, as described in section 8, and is told only that the card was declined;
- block further cards sent from that account under the same recipient name. To stop all mail to an address, use the reply code or write to support@giveadam.download;
- ask us to mail nothing more to an address: use the reply code from the back of the card or write to support@giveadam.download; we may ask you to confirm that you receive mail there;
Cards mailed to a typed address always carry the sender's first name or initials. A card with no name on it can only reach someone who accepted it themselves through a claim link.
7. Prices, payment, and tax
- One card is $13.00. Two cards are $23.00, sold as one card plus one credit. Prices are in US dollars and include any sales tax that applies; nothing is added at payment. For a card mailed to a Texas address, the listed price includes the Texas sales tax that applies.
- Payment is taken by Stripe, with Apple Pay or a card. We never see or store your full card number. The card you buy is a physical good, so it is not an in-app purchase and Apple is not the seller.
- A free promotional credit is good for one card and expires 40 days after it is granted. Purchased credits, including the credit from a bought pair and the cards bought by a subscription month, never expire. Credits are not transferable to another account. The single-card and pair credit rules do not govern subscription refunds, which follow sections 8 and 13.
- Postage within the US is included in the price.
The subscription is $13.00 a month or $142.00 a year per card, tax and US postage included. Each paid subscription month buys its cards, and those purchased cards do not expire.
8. Changing your mind, cancellations, and credits
The following bullets govern a single card and the pair. Subscription cards follow the subscription paragraphs in sections 3, 7, 8 and 13.
- Cancelling while you wait. You can cancel a paid card in the app until its batch closes, at 10am Pacific time on the Tuesday before the mailing date we showed you when you paid, or until we mail it, whichever comes first. The app names that Tuesday and 10am Pacific time as the last moment to cancel. A card sent by link has no cancel date until the recipient adds their address; until then you can cancel it at any time. After the address arrives you can cancel until that week's batch closes or we mail the card, whichever comes first. We return what you paid for that card less a $5 cancellation fee, to your original payment method. The $5 cancellation fee helps cover the work and costs of preparing cards that are cancelled. For a pair cancelled whole we return $18 and remove the unused second card; once the second card has been used we return $5. If you then cancel that second card too, while it can still be cancelled, we return its $13 to your original payment method instead of a credit, so the pair returns $18 in either order. The $5 fee applies only to an order that stored the cancellation terms you accepted at checkout; an order without them pays no fee, and its sender cancels by writing to support@giveadam.download. Refunds already made count toward these amounts. We return only the amount still due. A pair never returns more than the $23 paid for it: when the first card's refund already covers all $23, cancelling the second card returns nothing more. A card paid with a credit returns the credit and no fee applies, except the second card of a pair whose first card is already cancelled, which returns money as described above. The fee never applies when the cancellation is ours or follows a delay.
- If we are delayed. For a card paid with money, if we learn we cannot mail by the date we gave you, we tell you before that date by email and in the app, with a new date and a choice: wait, or cancel for a full refund. You choose by the original date. If we do not hear from you, we cancel the card and refund everything you paid for it. If you agree to wait, you can still cancel for a full refund until we mail the card. The cancellation fee never applies after you agree to wait. If we need another delay, we ask again. If we miss a date without your agreement to a new one, we cancel and refund in full without being asked. When we are late (you cancel after a delay notice, you do not reply, or we miss the date), a pair returns all $23, whether or not the second card has been used. That includes a pair whose first card you cancelled earlier with the fee: if we then cannot mail the second card by its date, we return the rest of the $23, the fee included. A card paid with a credit gets no delay choice; if we cannot mail it by its date, we cancel it and return its credit, or, for that second card of a pair, the money still due for the pair.
- How refunds are paid. When we owe you a refund, we send it to your original payment method within seven working days. Your bank controls when it appears in your account. If that method cannot receive the refund, we pay you by check or money order within seven working days of learning that, and we write to you for the mailing details we need. Money already returned through a refund or a chargeback counts toward what we owe you; we do not return the same money twice.
- To change an address or a name after payment, write to us before the card is printed. If we cannot change it safely, we cancel the card and refund it in full to your original payment method, with no fee; a card paid with a credit gets the credit back, or, for the second card of a pair whose first card is already cancelled, the money still due for the pair, to the original payment method. You can place it again.
- Once your card is marked mailed it cannot be cancelled, recalled, or changed. Physical mail does not come back.
- Automatic refunds. A card we decline after screening, a card the recipient declines and a link not used within 14 days of your payment are cancelled and refunded in full to the original payment method with no fee; a card paid with a credit gets the credit back, except the second card of a pair whose first card is already cancelled, which returns its $13 to the original payment method, unless the pair has already been refunded in full. For a pair cancelled whole, a full refund is $23 and removes the unused second card. When we decline the card, the recipient declines it, or its link is not used, a pair whose second card has been used returns $10 ($23 less $13 for the card kept); the same applies to a change we cannot make safely. When we are late, a pair returns all $23, as described above.
- Contact. We read support@giveadam.download daily. Write there if an in-app cancellation fails or a notice does not reach you.
- A card that does not arrive. If a card has not arrived 21 days after the date we marked it mailed, write to us with the serial number within 30 days of that date, and we will print and mail it once more at no charge. After 30 days the print files and a one-time address are deleted (Privacy Policy), so a card reported later becomes a credit instead. We cannot reprint a card whose address was entered wrongly by the sender, and we cannot chase mail once it is in the post.
- A card with a mistake we made. If we printed the wrong version, the wrong address, or damaged the card, write to us. We reprint it, or, if its files are already deleted, refund what you paid for it.
- Promotional credits expire 40 days after they are granted. Purchased credits, including a bought pair and a subscription month, never expire. If we stop offering the Service, we tell you at least 40 days ahead and provide a way to settle unused purchased value.
For a subscription, cancelling in Your cards stops future charges at the end of the paid period. Nothing is refunded on cancellation, and every paid month is still made and mailed. On account deletion, every funded card-month unit not yet mailed is refunded through Stripe to the original payment method at $8.00, up to what was paid for it, less any refund already made. This applies to both plans and includes a card already made but not yet mailed; mailed cards receive no refund. We issue the refund through Stripe within 30 days of your deletion request. A refund still in progress must settle before deletion finishes. We finish deletion within 30 days of your request, unless a payment dispute you opened with your bank is still open. If the processor needs something from you, we contact you by email before your details are removed. Stripe retries a failed renewal payment for up to two weeks; the subscription ends if payment cannot be collected, and you may enrol again at once. A disputed charge holds the months it paid for while the dispute is open; if the dispute is lost, those unmade units are closed as charged back and the subscription stops.
For a subscription card that has not arrived 21 days after it was marked mailed, write to support@giveadam.download with the serial number within 120 days of that mailing date. We reprint and mail it once at no charge from the retained files. A mistake we made in printing or addressing is also corrected by a reprint at no charge. Subscription files are kept for 120 days after mailing, or longer while a dispute or refund hold needs them; a reprint starts that period again. Once those files have been deleted, we cannot reprint the card. A lost subscription card does not become a credit. If we decline a subscription card before mailing, we hold that funded unit and contact you to arrange a suitable replacement; it does not become an ordinary credit. Account deletion instead follows the refund rule above. We cannot reprint a card whose address you entered wrongly or recall mail already posted.
9. Reply codes
- The reply code on the back lets the recipient send a card back at $2 off, once. Scanning the small square code on the back, or opening giveadam.download/r/ followed by the six characters, shows the same two choices: send a card back, or ask us to mail nothing further to that address. If you allowed replies at checkout, a reply card is addressed to your saved address without the recipient seeing it; if you did not, or you have no saved address, a reply reaches you through a claim link or an address the recipient types.
10. Privacy
Our Privacy Policy explains what we keep, for how long, and who processes it for us. The short version: operational answers are encrypted with a per-card key destroyed within 24 hours of the line settling and always within seven days of payment; a plain copy of the answers and the settled card's facts stays in the record store while your account exists so the operator can learn what people like and make better cards; daily database backups hold both stores for seven days; single-card and pair photos and print files are deleted 30 days after mailing, with the subscription exception below; we do not sell data and we run no advertising.
For a subscription card, the photo, panel and print file are kept for 120 days after mailing for payment disputes, or longer while its month is held for a dispute or refund; account deletion clears those files as section 13 describes; a dispute opened in the moment a file is being removed after its retention period may find that file already gone, in which case the order record answers the dispute. Subscription preferences follow the separate period in the Privacy Policy.
11. Ownership
- You keep every right you have in your photo, your answers, your note, and the words you wrote yourself. A line or poem drafted by the app or written by the person who runs this service is made for your card; you may keep and share the physical card freely, and we claim nothing in it beyond that.
- The app, its design, its typography, its wording, and the way a card is composed are ours. The small artwork produced for the panel (the stamp or watercolor reduction) is made for your card; you may keep and share the physical card freely, but the app and its templates are not licensed to you for anything else.
- We never reuse your photo, your line, or your card for marketing, examples, or training unless you tell us in writing that we may.
12. A paper card, not care
The Service makes a postcard. The questions are personal and the line can be direct, and that is all it is: a card. It is not a substitute for a doctor, counselor, lawyer, or any professional. Nothing the app produces is advice, and you should not act on a line as though it were. If you are in danger or thinking about harming yourself, contact your local emergency number; in the United States you can call or text 988 at any time.
13. Your account
- You can delete your account in the app. The moment you do, we sign you out and you can no longer sign in to that account. A deleted account cannot be restored, by you or by us. If a paid single card or a card from a pair is still within its cancel period, we cancel it with the change-of-mind refund in section 8. If a delay notice is open or you have agreed to wait, deletion cancels the unmailed card with the full refund in section 8. Otherwise, after its batch has closed, the card is still mailed and deletion finishes after that. A refund still owed to you must settle before deletion finishes; we finish deletion within 30 days of your request, unless a payment dispute you opened with your bank is still open. The unused second card of a bought pair is refunded to the original payment method: $23.00 less $13.00 for the card kept, less any refund already made on that pair. Promotional credits are forfeited. We then delete your card records, including the plain answers, lines, poems and notes, destroy your remaining operational answer keys, delete photos, panels, print files and queued pictures, and remove readable addresses and other personal details. The limited records needed for tax, accounting, fraud, blocks and legal claims remain as described in the Privacy Policy.
- We may suspend or close an account for a breach of section 5, for chargebacks or fraud, or where the law requires it. Single cards and cards from a pair not yet mailed are cancelled and refunded in full under section 8, with no cancellation fee; a card paid with a credit gets its credit back, or, for the second card of a pair whose first card is already cancelled, the money still due for the pair, to the original payment method. Subscription cards follow section 8.
When you request account deletion, we stop subscription fulfilment, cancel remote billing and close all open subscription invoices, including invoices attached to an already ended subscription. If payment reaches an invoice before it can be voided, we reconcile that payment and refund any amount that bought no funded units. Every funded card-month unit not yet mailed is refunded at $8.00 to the original payment method, up to what was paid for it, less any refund already made; mailed cards receive no refund. We issue the refund through Stripe within 30 days of your deletion request. A refund still in progress must settle before deletion finishes; we finish deletion within 30 days of your request, unless a payment dispute you opened with your bank is still open. We sign you out at once and you can no longer sign in to that account. We email you when deletion has finished, and also when it starts if it cannot finish at once. If billing, a refund or file removal is unfinished, the service retries without you. Once billing and refunds are settled, we clear your preference text and its history and remove personal data. Subscription and consent records stay for accounting.
14. What we do not promise
- The Service is provided as available. We do not promise it will always be available, that a drafted line will suit you, or that any card will arrive on a particular day.
- Where the law allows, our total responsibility to you for an ordinary claim about one card is limited to the amount you paid for that card. We are not responsible for indirect or consequential loss, including anything that follows from what a card says or from a card being read by someone other than the recipient.
- Nothing in these terms limits responsibility that cannot be limited by law, including for fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or rights under consumer law.
15. Your responsibility to us
If a claim results from a photo, a name, or a card you used without permission or in breach of section 5, you are responsible for the reasonable costs caused by that breach. This does not cover our own conduct.
16. The App Store
The app is distributed through Apple's App Store under Apple's standard license terms for apps. Apple is not a party to these terms, does not sell the card, and has no obligation to support the Service or to handle any claim about it. If the app does not meet a warranty that applies to it, you may tell Apple and Apple may refund the app's price (the app is free, so that amount is zero); every other claim is ours to handle. Apple and its subsidiaries may enforce this section as a third-party beneficiary. You confirm you are not in a country under a US government embargo and are not on a US restricted-parties list.
17. Disputes
These terms are governed by the laws of the State of Texas and the United States. If something goes wrong, write to support@giveadam.download first; most problems are a reprint, a refund or a credit. If we cannot settle it in writing within 30 days, either of us may bring a claim in a court that has jurisdiction, and you may use the small-claims court where you live if it has jurisdiction.
18. Changes to these terms
We may change these terms. The version date at the top changes when we do, and the app asks you to accept the new version before your next order. If you do not accept, cancellation of an unmailed single card or card from a pair follows the periods and refunds in section 8. A subscription follows sections 3, 7, 8 and 13. A credit can be used only under the version in force when you order with it.
For a material change to a subscription offer you accepted, we email a clear notice of the change and how to cancel before the change takes effect. If a fee changes, we email the notice no fewer than 7 and no more than 30 days before that change takes effect, with information on how to cancel. Each notice states the effective date in UTC, describes the change, and gives the cancellation route and business contact. You may cancel in Your cards before the renewal date to stop the next charge. If we cannot send the required notice in time, we defer the change for the affected subscription. The notice does not replace any consent the law requires.
